Q: Used Car Dealership ripoff….or AS-IS sale justified?
I brought a 92 Civic from a used car dealership alittle under a month ago for my job so I can have a simple car to drive to work and back home…I test drove the Civic and it seemed fine..no leaks, no crazy noises from the engine, everything seem to work fine except the instrumental panel lights and the car door locks which is pretty minor to me.
So I brought the car AS-IS for $2300..he even showed me the Blue Book price and it was the right price.

25 days later these are the problems I have been having with the car:

Coolant Leak from behind the engine.
Timing Belt is cracked.
Radiator fan don’t work.
Car shakes(almost a jerk shaking) when in Drive and Reverse but is fine in Neutral and Park.
Car will crank BUT won’t start…fuel isn’t even getting to the fuel filter(this happened TODAY at work).

TODAY I called the used car dealership where I got the Civic from and told him(the manager) to give me a refund because EVERY SINGE car in that lot is the dealership’s responsibility and they should know what is wrong with every car on the lot and TELL the customer the defects or or anything that’s wrong with the car…..When I brought the car..he didn’t tell me anything like that..he said the car is good and rides good.

YES..I know was an “AS-IS” buy BUT if the dealership told me what was wrong with the car ..then I would have had 2nd thoughts about buying it. Yeah I could have brought it to a Mechanic…but it was low on gas for some reason….maybe that was a trick so I won’t have enough gas to get to a Mechanic and back.

Anyway I called the Dealership and he didn’t wanna give me my money back….So I told him..”Ok since you won’t give me my money back..or I’ll just print 2000 flyers with a picture of my 92 Civic with a list of what’s wrong with the car, your dealership’s name, address, phone number and how long I had it(less than a month) & give those flyers out in front of Wal-Mart and Target..sounds good?”.
He said I was talking crazy and the flyers are stupid and I could hear he was nervous in his voice….But I told him “Whatever I put on those flyers is gonna be true and stating the facts so it’s not crazy or stupid right? and it’s way too easy to do.”
I also told him I would talk to a Lawyer as well…that’s when he hungup.

Only thing I did wrong was TRUSTING an car dealership and not taking the car to a Mechanic..it’s a hard way to learn but it’s the dealership’s responsibility to know(or have a list) of what’s wrong with EVERY CAR on THEIR lot.

Is this True or not?

Did I do the right thing calling them up about the Civic and what I would since they won’t give me a refund.

P.S: I might look kinda funny giving out flyers in front of Walmart and Target….but the Message is pretty clear…Don’t shop at “Airport Auto Sales” in Killeen, Texas. OSme might think it won’t do anything…but some will think twice before going there.

There is NO LAW against letting people know the truth and state the facts on a flyer and handing it to the public. That’s like saying protesters can’t say their opinion in public…and that’s even a louder voice then what I’m doing.
Yeah protesters get arrested..but because they don’t leave the property or move out the way..not because they voice facts and opinions.
So I guess ONLY the customer has the responsibility to see and say what’s wrong with the car right?

A: “As Is” means as is. Its not the dealerships job to inspect the car its YOUR job. Its as simple as that. If you cant check it out properly then you pay $50 or something to have a shop somewhere check it.

You bought an 18 yr old car. You have to know something is going to be wrong with it.

Slander isn’t something you want to do either. Be prepared to get yourself a whole lot more problems.

Q: Does anyone know anything about used car consumer rights-please only answer if you really KNOW-don’t guess?
I just bought a used 2000 Ford Escort five days ago from a dealer. So far, my horn stopped working, the air conditioning stopped working, the heat stopped working, the windshield wipers stopped working (unless I’m using the water too and then they only move for a second or two, with the water flow), the service engine light came on and stays on, and now the car jumps forward when I’m driving in slower stop/start traffic). Does anyone know anything about my rights under a used car sale (please don’t guess, thank you), and/or if the last thing – car jumping forward – might be the transmission?
By the way, Lemon Law does NOT apply to used cars – only new.
If anyone knows different, please show me a site that states this, thanks.

A: You may not like the answer – but here goes. Its your car. Unless there is a specific warranty in writing, all used cars are sold as is.

And to the person ahead of me – NO there is NOT a three dya return right – anywhere. That simply is not true.

Now. There may be a couple of things to remedy. First, most states have minimum safety standards that a dealer must meet. They cannot sell a car that is unsafe. One could make the argument that wipers are safety related, since you cnat see to drive in the rain.

If your state requires that cars pass emissions or safety inspections, get the inspection done immediately. You only have a few days to comply to get any legal help. If the car will not pass the safety or smog inspections, then check your state’s laws as to what the resolutions are. Some states say that the dealer can fix those items, some say that they have to take the car back.

if your state does NOT require those inspections, then unfortunately you own a car with problems. This is why a pre-purchase inspection is critical.

The Check engine light can come on for a number of reasons. If you go to your local Pep Boys, Kragen, or similar stores, they will put the OBDII scanner on the car and tell you why its on. Given the lurching you mentioned and the engine light, it could well be a transmission issue.

But get these things done immedaitely. Time is not on your side here.

Q: Where do I stand having sold a used car that has gone wrong?
Hi guys. I was just wondering if someone could give me some advice.

Basically, I am a recently established motor dealer and sold a 2001 car for £5000 and unfortunately after 3 weeks the owner called me to say there was a fault with the gearbox.

All of the cars I put a good quality aftermarket warranty on and this particular one covered a value upto £2000 including labour. I advised him to go to his local garage (having spoken to the warranty company) who would fix the fault and claim on the warranty. He then said he couldnt find a garage he trusted – so as the car was not running very well and he lived 3.5 hours away I paid for a transporter to recover the car to me 4 days later (the earliest they could do).

The car was taken to a gearbox specialist who failed to diagnose the fault having had it for 4 days. I then arranged for another garage to have the car. They diagnosed the fault and contacted the warranty company who said that as it was such a large repair, would require their inspectors to come and diagnose the issue.

Basically, the warranty assessor took nearly 3 weeks to come out, having cancelled 3 appointments and after continual chasing, when they eventually turned up confirmed that the fault was what the garage stated. They went away to compile their report, and 3 days on and lots of chasing I decided to complain to the warranty company. The company are represented by a well known tv personality who I wrote to, and he personally got involved the next day, authorising the work and supported me saying they assessors have been useless.

Meanwhile, I received a letter from the owner of the car trying to reject it under the sale of goods act. I spoke to trading standards who told me I had an opportunity to repair the car given he owned the car for 3 weeks and covered over 1000 miles and he wouldnt be able to reject. I wrote back to him stating that he had accepted repair and this was being processed. He insisted then that trading standards were on his side etc.

Meanwhile, we sourced a brand new gearbox for the car as well as several other parts that were not really needed but made sense to replace. Instead of using reconditioned parts (which by law was all that was required), we decided to pay the extra and have new ones put on so that he had a decent guarantee. The car had only covered 35,000 miles by the way and is 8 years old.

Anyway, i have sinced received a 2nd letter demanding a full refund within 7 days or he wants to take legal proceedings.

The issue is, trading standards said a reasonable time period must be tolerated and its just over a month now off the road – not helped by the warranty company’s 3 week time to inspect, but this was out of my hands. Given that the work is around £3000 all in, the last thing I wanted to do was complete the work and invalidate the claim without inspection. I explained this to trading standards and asked how long was acceptable…and to quote they said ‘how long is a piece of string’ but did also say that as it was a major part of the vehicle, a longer period of time must be tolerated, particularly with a warranty company involved.

The gearbox was going to be 5 day delivery but I personally went and collected this so it could be fitted the same day. It then emerged that as it was a new part a new transfer box was needed too….which tomorrow im driving to manchester for in order to get it fitted quickly by the weekend.

Im at my whits end to be truthful and have spent a lot of money and time getting this finalised. I genuinely just want to the guy to have his car back.

I wrote back to him stating the car will be finished by tomorrow and included a lot of facts including a detailed log from the warranty company stating dates etc. of correspondence, emails from the celebrity stating they caused the delay, etc.

Just wondered if someone could offer some advice? ultimately, im an honest guy and have not dodged/dived the issue at all. I reported it from day 1 and even took the work on myself and paid £350 to have the car recovered. I would really like to know where I stand legally.

A: As the fault was obviously internal you had no way of knowing that it existed even if it was faulty or about to go wrong.
In taking the guarantee the buyer accepted that expensive unknown faults could occur with the vehicle from the time it was driven away.
If it was a preexisting fault that you had hidden in some way then the buyer would have a case – clearly they do not.

It is possible that the gearbox was damaged in the 3 weeks that it was used since you sold it and there is no way either you or they could prove or disprove that.

You seem to have taken all possible measures to get the car sorted and have been let down by the warranty company.

I suggest that you reply to the customers 7 day notice and make the points detailed above and keep a copy of the letter in case of further action. I would also write to the warranty company and ask them what compensation they propose to pay both you and the customer for the postponed appointments and the time taken to deal with what should have been a straightforward matter. Do not accept liability in any way and make the point that any costs you have met were a good will gesture and no more.

The only course of action open to the customer would be to go to a small claims court. I believe if consulted a solicitor would advise them not to do it as they would most likely lose. If they did do it and win then all they would get would be a County Court Judgement which is barely worth the paper it is written on being virtually unenforceable.

Good luck with that and stand your ground.

My GF is from Europe and loves Mercedes. For sale is a: Mercedes 190 E, 200K, “runs well”. 1 owner. $1600. Blue book is $2000.

My GF thinks this is the deal of the century. I’m concerned that a car with that many miles is gonna need a new engine, timing belt, and/or transmission.

She’s being real stubborn about 2 things…spending under $2000 and buying a Mercedes. These two things don’t go well together as used Mercedes are pricier than other brands. What would u tell her if this was ur GF?

A: Simplet thing really. Tell her this is not Europe and Mercedes Benz don’t come here cheap and don’t die here cheap either. First of all the mileage is way too high, you would spend more money fixing the car in the first year you had it than you paid for it. Plus there are no Benz parts makers here in the US, so you would be paying more for parts than usual cars. Tell her that you need to get a good little Jap car for now that will run good and not break down on you, and save up for something better. You are basically gonna be paying 2K for the Benz name, not the car.

Ive been looking online for a used car,and found this car. Its from Southern California Auto Sales. It was over $1,000 UNDER the “fair” kelley blue book price. I called and asked about any accidents, and the guy said he doesn’t know about accidents, but its a clean title and I should go check the carfax myself (they dont offer it). A: checked the link the car looks good, for mileage and options price seems very good. in terms of the carfax the dealer should have it and if he doesnt he should pay the 15 bucks or so to get it. never buy a used car from a dealer who is unwilling to somehow produce a carfax report; the reports are so cheap and quick to obtain if a dealer is willing to jeopardize a sale and not show you theyre probably hiding something

Q: How much hidden cost is there to flip a used car?
I know someone selling their car for well under the retail value because they are moving. I could easily sell the car in its current condition for $2000 more than what he is asking. My question/concern is how much money do I have to spend outside of the asking price of the car to make this work? The hidden costs basically.

For instance, I assume I would have to pay sales tax, cost for a new title, new registration for the car, new plates? adding the car to my insurance for a short period? The car is being sold for $7500 and is easily a $9500 car. Probably more if I put some time into it. I live in Florida. I would not be selling any car I currently own, I would be doing this simply to flip the car and make money.

If any experienced car flippers/mechanics could give any advice I would greatly appreciate it. I do not want to end up costing myself when I thought I was making a good investment.

A: You would have to pay the sales tax and title the car in your name. You would not have to put tags on the car, unless you were planning on driving it on the road.

If you are not driving the car, adding it to your insurance is not required, but may be a good idea to protect your investment. If the car is damaged or stolen, you want to be able to get your money back.

Be careful about the price. If the car is truly worth a lot more than the person is selling it for, the professionals (dealers) will be lining up to buy it. If you can easily sell the car for $9500, why can’t the current owner?

If you send me the information on the car, I will research the actual value for you. I am in the DC area, so you know I will not be traveling to FL to buy that car, so that is not a worry.

A: I tried the link and it says it is not listed anymore.

But the SAAB 9000 ‘93 up is the best car SAAB ever made hands down.

I have been working on European, SAAB and Volvo mostly for 15 years, and out of all the cars, the 9000 is the cheapest to maintain.

The fuel pump fails around 115k-150k miles. ($600.00)

If it is a turbo model, the IDM or also know as the Direct Ignition Cassette fails around every 60k miles. ($500.00)

Check for timing chain noise, on these earlier 9000’s, the balance shaft gears are weak and the gears wear out. If the chain breaks, the valves hit the pistons and cost a lot of money to fix. Timing chain and gears can cost up to $800. If the chain breaks, it can cost up to $1500.

Other than these issues, the engine will last forever, the transmission, manual or automatic hold up well, just as long as the fluid is change when it supposed to.

Q: Used Car Deposit £2K refund where do I stand?
I test drove SAAB Tdi on 27/03/2010 and I quite liked it, the sales advisor priced it for £7333, I paid £2000 as a deposit with my Visa Debit Card, the deal was under their own scrapage allowance they were going to take my car in P/X without seeing it pay £2000 for it and arrange finance for £3333.

Now I am in a process of buying a flat in London so I requested to not do the finance bit till my house procedure is completed, unfortunately the bank has asked me to pay more monies & I have to back off this deal.

A: He is a Sales Man. Get over it. He will want to make the sale. If he will not give your money back, the car is yours, that’s what I think. Request title.
The reality here is true, you might have bought the car already, so get the keys, and drive it home. You will probably have to wait to move, or resale the car, then move. Tough lesson, I know.
But I think you deserve the car, NOW, especially since you put a down payment on it. Down payment, or deposit means the car is on hold for you, no one else, and they can not sell it from under you. The deposit goes towards the car, and that is probably the way it’s going to be.
I know, where’s good cop when you need one. I personally think the sales man could wait until you get your finances in order, then he good make a good sale.

A car dealership is holding my money hostage to force me to sing for a car, after they destroyed their contract that i had singed, when i was trying to exchange a car that i had bought the day before (Cadillac) that over heated on the way home for another car (Toyota) that cost $500 more than the 1st. I told them that my mom didn’t like the Cadillac because its a v8 and its going to cost me too much for gas, fearing if i told him that it overheated he would have told me that its not his problem, because i bought it “as is”. He told me there was no need to pay for another transfer fee, since i had bought the car almost at closing time n came back the next morning right before they opened, they never had time to put the car under my name or process any paper work. When i went to sing for the Toyota (the car i was exchanging the Cadillac for) the sales rep. garbed the original paper work from the Cadillac and ripped it n threw it in the garbage, then pulled out another contract and told me to sing for everything again. He set the Toyota $2000 higher than the previous day, i was shocked, and asked him “why?” He told me that the price set yesterday was only for yesterday, now its $2000 higher. I know he was just trying to get as much money from a young person, I’m 19. I refused and walked out with the paper work that he ripped up and the contract that of the Toyota the he tried to make me sign, and left both cars there. Just then he noticed that i forgot an envelope which enclosed was a copy of the deal with the Cadillac and a blank check that i was going to use to buy one of the cars. He garbed it and flashed it to me, screaming “we still got you” i turned right back and walked right after him (by now he had put the envelope in his desk drawer). I demanded for what rightfully belongs to me. he told me no, and if i didn’t leave he would call the cops. i took a step forward and he pushed me back, then i took another step forward and he pushed tried to push me again, i dove right under his arms and went for the drawer, i reached the envelope and put it in my jacket, in the process the sales rep. put me in a choke-hold. i managed to free myself and run out of the place. They called the cops on me but no charges where filed against me because i was within all my rights.
Its a family owned dealership. If i do sue it would be a civil lawsuit.

A: Good grief! You need to go to a more reputable dealership. Sounds like the Guido Brothers mob…… lol. You can file a civil suit. Just go to the courthouse, and depending on where you are it might cost you $25 – $30 to file the papers. If you should by chance have any bruises or marks from the strangle hold placed on you. I would definitely have photos taken as evidence. Of course, it’s going to be your word against theirs, but if you have proof of marks on you, that should hold up as well in court.
I definitely recommend you not do any further business with these guys. They sound like a bunch of thugs to me. Good luck.

Q: Question about second chance financing and returning a lemon.?
I purchased a 2001 acura cl with 107,000 miles for $9800 bucks. My apr is 21% (i know it is very high), I put $2000 down and my monthly payments are $377 bucks a month for 33 months. It’s a jacked up deal but because my engine in my old car died, i HAD to get another car.
I have a really high debt to income ratio and been behind on a couple credit cards for the last 3 months. So my credit score has dropped quite a bit. I had to do special financing. So the car i bought is garbage. I took it home the first day and it would not start again for about 10 mins. Then it started but did the same thing 2 days later. I had to have the car towed back to the dealership. I asked at that point to return the car because i was having a bad feeling about the future issues with the car. The said i couldnt return the car. The said the issue was i needed a new fuel injector or something. so the replaced it and sent me on my way. The car did the same thing 3 days later. They said it was the battery, so they replaced it and sent me on my way. Then it happened again a couple days later. They put the car in the shop for a week and called me to pick it up. I go to the svc dept to get the paperwork to see what was done and they told me they did nothing to the car because it started for them everytime they tried. So i take the car home and the next day, it did the same thing!

I went back to the dealership today and they said they will sell me a 98 ford mustang with 59000 miles for $8000. The kelly blue book says the asking price should be $6200 from the dealership. i asked the sales manager and he told me that because it’s “special financing” the second chance lender tacks on all these fees. Now my question is, if 8000 is the sale price, the lender dont see any of that money. The lender makes their profit from that high interest rate they are charging me, right. I just want to know if the dealership is feed me a load of crap or not. I would think the would bend over backwards for me after selling me a lemon that left me stranded four times.

The car dont fall under the tx lemon law because its a used car and not under the original warranty. I’m told that if i try to give the car back, they will keep my $2000 deposit because they sent most of it to the state for title and taxes. I think they are not being truthful about most of the stuff they told me. I think they are doing everything they can to keep this deal. What should i do?? any advice would help! Thanks!!

A: You bought a car. You did not have it checked out by your own mechanic prior to purchase, You took delivery of the car, and signed the finance contract. You had several problems with the car, which the dealer attempted to fix under warranty for you. They were unable to duplicate the problem that you are complaining about, and unless they can, they can not fix it.

You now want to trade the car for another car. The dealer is willing to do so, but they are charging you a price that you consider to be too high. You have two choices, you can keep the first car, and make your payments, or you can trade it in for the second car, at the price the dealer is charging.

If you just bring the car back and drop it off, it will be considered a repossession. The finance company will sell the car, and the amount of the sale, less all costs of title, towing, storage and sale will be deducted from the sales proceeds. This will be applied to your loan balance, and you will be sued for the difference. The finance company will get a judgment, attach your wages and bank accounts, and ruin your credit for 7 years.

Any money you put down would be gone, and you would have no car, and still owe money.

Q: Is this car worth buying? (Mitsubishi Eclipse)?
Hi I was thinking about buying a used car and was wondering whether its worth it. I really want to buy a Mitsubishi Eclipse year 2000 and up but I only have a $5000 budget…I know this is very low. But I have looked and found a lot on sale for 5k and under but they have a high mileage. Is it worth getting an eclipse with about a 100,000 miles on it or more?

A: One of the keys to pricing a car is to effectively rate the car as the price will vary widely based on condition and mileage. Mileage is pretty obvious. You should base condition on a Carfax report (which would also help catch any odometer fraud) and your own review. Before you buy your final step should be an inspection by a qualified mechanic – but that’s too expensive to do on every car you look at.

There are a bunch of places to check car prices on the Internet. NADA guides is one – but since they are owned by the car dealers association I never recommend them. KBB is another. Driverside.com is a new site and they have a couple of extras – great data showing price based on mileage; DriverSide Estimate where they search actual listings to find what cars are actually selling for in local markets; and estimates for trade in pricing.

Also take a look a the DriverSide cost of ownership – service, gas, insurance and even depreciation to see how the price will drop over time. I find that most folks look at the one time sales price – not the ongoing costs which continue long after you buy your car.
